PASS & NOTE LEGAL

Terms & Conditions

These Terms & Conditions govern your use of the Pass & Note applications, website, and related features.

By using Pass & Note, you acknowledge that you have read and understood these Terms & Conditions and agree to use Pass & Note in accordance with them.

1. About Pass & Note

Pass & Note is a privacy-focused application for storing passwords, secure notes, and related information in an encrypted vault under the user's control.

Pass & Note is designed primarily around local storage and user-managed encrypted backups.

Pass & Note does not provide a hosted copy of your vault.

2. Your Master Password

Your Master Password is an important part of protecting and accessing your vault.

Pass & Note does not maintain a recoverable copy of your Master Password and cannot recover or reset it for you.

You are responsible for remembering and protecting your Master Password.

Loss of the Master Password may result in loss of access to your vault or encrypted backup files.

3. Your Responsibility to Maintain Backups

You are responsible for creating and safely storing current backups of information that is important to you.

If your device is lost, stolen, damaged, reset, replaced, or otherwise becomes unavailable, or if Pass & Note or its local application data is removed, information that has not been backed up may not be recoverable.

You should periodically verify that important encrypted backup files remain available and can be accessed using the appropriate password.

4. Exported Files

Pass & Note may allow you to export encrypted vault, password, or note files.

You are responsible for where these files are stored, copied, transmitted, or shared.

Encrypted files remain dependent on the credentials required to decrypt them.

If Pass & Note allows you to intentionally export information in plaintext, you acknowledge that the resulting file will not have Pass & Note's encrypted-vault protection.

5. Web Access

The Pass & Note website may provide tools for opening supported Pass & Note encrypted files locally in a compatible browser.

You are responsible for using trusted devices, browsers, and networks when accessing sensitive information.

Do not enter your backup password or open sensitive vault information on a device that you do not trust.

6. Security

Pass & Note is designed with security and privacy as important considerations, but no software or security system can guarantee complete protection against every possible technical failure, device compromise, operating-system issue, malicious software, hardware failure, or other unforeseen event.

You are responsible for maintaining reasonable security for your devices, credentials, and backup files.

7. Availability and Compatibility

Pass & Note may be updated, modified, or improved over time.

We aim to maintain compatibility with supported Pass & Note backup formats, but availability may depend on operating-system versions, browser capabilities, device functionality, application-store requirements, and other technical factors.

You should not rely on a single device as the only copy of important information.

8. Acceptable Use

You agree not to use Pass & Note:

  • for unlawful purposes;
  • to interfere with, damage, reverse abuse, or disrupt the service or website;
  • to distribute malicious software or harmful material;
  • in any manner prohibited by applicable law.

You remain responsible for the information you choose to store using Pass & Note.

9. No Professional Advice

Pass & Note is a software utility and does not provide legal, financial, medical, security-consulting, or other professional advice.

You are responsible for determining whether Pass & Note is appropriate for your particular requirements.

10. Disclaimer of Warranties

Pass & Note is provided on an "as available" basis to the extent permitted by applicable law.

While reasonable care is taken in developing and maintaining the software, uninterrupted operation, permanent availability, compatibility with every device, or complete protection against every possible form of data loss or security incident cannot be guaranteed.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded under applicable consumer-protection law.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Pass & Note and its developer will not be liable for indirect, incidental, special, consequential, or similar losses resulting from use of or inability to use Pass & Note.

This may include loss of locally stored information arising from circumstances such as loss or failure of a device, deletion of application data, forgotten credentials, unavailable or corrupted backups, operating-system failures, or circumstances outside the reasonable control of Pass & Note.

This section does not exclude or limit liability where such exclusion or limitation is prohibited by applicable law.

12. Third-Party Services and Platforms

Pass & Note may depend on third-party operating systems, application stores, browsers, hosting infrastructure, or other platform services.

Those services are governed by their own terms and policies.

If you obtain Pass & Note through the Apple App Store or Google Play, additional terms imposed by those platforms may also apply.

13. Intellectual Property

The Pass & Note name, application design, website content, branding, and original software components are protected by applicable intellectual-property laws.

Third-party and open-source software incorporated into Pass & Note remains subject to its respective licenses and notices.

14. Changes to Pass & Note or These Terms

Pass & Note may evolve over time.

These Terms may be updated when features, technical requirements, legal requirements, or service practices change.

Material updates will be reflected by changing the effective date or last-updated date shown on this page.

Continued use of Pass & Note following an applicable update constitutes acceptance of the updated Terms to the extent permitted by law.

15. Ending Use of Pass & Note

You may stop using Pass & Note at any time.

Before deleting the application or removing its data, you should create and verify any backup you want to keep.

Deleting the application may permanently remove locally stored vault information if no usable backup exists.
